1. Agreement
These terms apply when you use the Hisaab Kitaab website and app (the “Service”). By requesting access, creating an account or using the Service, you agree to them on behalf of yourself and the business you represent. If you do not agree, please do not use the Service.
2. What Hisaab Kitaab is
Hisaab Kitaab is data management and record-keeping software. It helps a business write down and organise its own information — orders, stock, customers, amounts it has received and amounts it says are due — and make bills and reports from that information. Everything in the app is entered by the business and its staff.
3. What Hisaab Kitaab is not
Hisaab Kitaab only keeps records. It is not, and does not act as:
- a bank, non-banking financial company (NBFC), lender or credit provider;
- a payment aggregator, payment gateway, payment system or wallet;
- a marketplace, e-commerce platform or aggregator of buyers and sellers;
- a collection or recovery agency, or a credit bureau;
- a financial, investment, tax, GST, legal or accounting adviser.
- We never receive, hold, collect, settle or transfer moneyfor anyone. Customers pay the shop directly, by whatever method the shop and customer agree. Marking an order as “paid” in the app only records what the shop says happened — it is not a receipt or proof of payment from us.
- We are not a party to any sale, credit (udhaar) or other deal between a shop and its customers or suppliers. Prices, quantities, credit, due dates and disputes are between them.
- Bills, reports, totals and reminders are made automatically from the shop’s own entries. The shop must check them. Whether a bill meets GST or other legal invoice rules is the shop’s responsibility — talk to your CA or tax adviser.
4. Accounts and access
- Access is by invitation. You can ask for access through our request form or WhatsApp; we may accept or decline any request.
- You must be at least 18 and allowed to act for the business you register.
- Give correct details and keep them up to date.
- Keep your password secret. The account owner is responsible for everything done through the shop’s logins, including by staff they add, and should remove staff who leave.
- Tell us quickly if you think someone else has used your account.
5. Your data and your customers’ data
Your shop owns the records it keeps in the app. You give us permission to store and process them only to run, secure and improve the Service for you, as described in our Privacy Policy.
You are responsible for the records you keep. In particular, you agree that:
- you have a lawful, fair reason to record each customer’s details and amounts;
- the messages and bills you send to customers from your phone are your own, are accurate, and are not harassing or threatening;
- you will not record data you are not allowed to keep, such as card numbers, bank passwords or ID numbers.
Keep your own copies of important records — use the export and download options where your plan includes them.
6. Fair use
You must not:
- use the Service for anything illegal, fraudulent or misleading;
- try to see another shop’s data, break security, or overload or disrupt the Service;
- copy, resell or rent the Service, or build a competing product from it;
- upload harmful code, or use bots to scrape the Service.
We may suspend or close accounts that break these rules, and will tell you why unless the law stops us.
7. Plans and fees
- Plans, prices and what each plan includes are shown on our pricing section or agreed with you when your account is set up. Prices may include or exclude taxes as stated there.
- Fees are for using the software only. They are not a fee for handling any money between you and your customers.
- We may change plans or prices. We will tell account owners before a change applies to them, and it will apply from the next billing period.
- If a paid plan is not renewed, the account may move to the Free plan or be limited until it is renewed.
8. Availability and changes
We work to keep the Service running and your data safe, but it is provided “as is” and “as available”. It needs an internet connection and may sometimes be slow or unavailable, for example during maintenance or problems with our providers. We may add, change or remove features over time; we will give notice of changes that significantly affect you.
9. Limits of our responsibility
To the extent the law allows:
- we are not responsible for business decisions, credit given, money not recovered, tax filings or disputes that rely on records in the app;
- we are not responsible for mistakes in data entered by you or your staff;
- we are not liable for indirect losses such as lost profit, lost business or lost goodwill;
- our total liability for any claim about the Service is limited to the fees you paid us for the Service in the 3 months before the claim.
Nothing in these terms limits any right you have that cannot be limited by law.
10. Closing your account
You can stop using the Service and ask us to delete your account at any time through Help & Support or WhatsApp. Deletion happens after a 30-day window, as explained in the Privacy Policy — download anything you need first. We may close or suspend an account that breaks these terms, stays unpaid, or puts the Service or other users at risk.
11. Law and disputes
These terms are governed by the laws of India. If there is a problem, please contact us first so we can try to resolve it. Any dispute that cannot be resolved will be handled by the competent courts in India.
12. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change is important, we will tell account owners inside the app before it applies. Continuing to use the Service after that means you accept the new terms.
